課程概述

There has been a steady "federalization" of American criminal law over the past 25 years with far-reaching implications for lawyers who represent companies or individuals conducting business in the United States or even for United States companies and citizens doing business abroad. With globalization a reality, a basic understanding of American Federal criminal law and procedure and the considerable, evolving role it plays is essential to students who might someday represent businesses and individuals whose interests intersect the American legal system.

Course Outline
I.Overview of constitutional governance in America (setting the stage)
II.Classification of offenses
III.Crime specific elements and intent requirements
IV.Criminal responsibility (accessories, aiding and abetting, conspiring)
V.Constitutionally protected rights
VI.The anatomy of a federal criminal case
VII.Selected federal offenses intersecting foreign interest in trade, commerce,and travel
VIII.Overview of the death penalty in America
 

課程目標
The object of this course will be to explore and foster an understanding of the American criminal justice system, with an emphasis on federal criminal law and procedure. Though the course will be taught with the basics in mind (using a combination of lecture and Socratic method), students will be encouraged to explore well beyond the basics. As a result, the course will be directed not only to those who might someday advise businesses and individuals whose interests intersect the American legal system but also those who simply seek to have a better understanding of the inner workings of the American criminal justice system.
